Please read the terms and condition before using this site (www.goulburnorganics.com.au) where you can browse, select and order products from Goulburn Organics ABN 30 119 833 061.

Your access to and use of this website is conditioned on your acceptance of and compliance with these Terms. The Terms apply to all visitors, users and others who access or use this website.

We reserve the right, at our sole discretion to modify or replace these Terms at any time and by your continued use of the web site you consent to these variations.

Orders
Customers may browse products on this site, add them to their cart and then checkout. On checkout the customer will be required to submit personal details including name, email, billing and shipping address and to make payment. An order placed on this web site is an offer by you to purchase those products for the price specified including the delivery charges and taxes.

Pricing and availability
All prices are in Australia dollars and include GST where applicable.

We cannot always guarantee that a product ordered by you on this web site is available or we may find at the time of packing the product from your order does not meet our standard. In this case we will either provide a refund for this particular product or communicate with you to include an alternative product.

All reasonable effort is made to ensure the information on this site is complete and reliable, however their may be typographical errors, pricing errors and other errors or inaccuracies. Any errors we will seek to correct in a timely manner. We also reserve the right to revoke any stated offer and to make changes to prices or content or product descriptions at any time without obligation to issue any notice of such changes including after an order has been submitted, shipped or received, except as prohibited by the law.

Payment
Payment is made using the Eway Payment gateway. Payments are accepted via Visa and Mastercard. This site does not store your credit card details with submission made directly to the payment gateway which then notifies this site of the success or failure.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted,
timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate
or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel
the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service
and all products and services delivered to you through the service are (except as expressly stated by
us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or
conditions of any kind, either express or implied, including all implied warranties or conditions of
merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement.
In no case shall Goulburn Organics, our directors, officers, employees, affiliates, agents, contractors,
interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct,
indirect, incidental, punitive, special, or consequential damages of any kind, including, without
limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar
damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising
from your use of any of the service or any products procured using the service, or for any other claim
related in any way to your use of the service or any product, including, but not limited to, any errors
or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the
service or any content (or product) posted, transmitted, or otherwise made available via the service,
even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or
the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our
liability shall be limited to the maximum extent permitted by law.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Goulburn Organics and our parent, subsidiaries,
affiliates, partners, officers, directors, agents, contractors, licensors, service providers,
subcontractors, suppliers, interns and employees, harmless from any claim or demand, including
reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these
Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the
rights of a third-party.

OUR QUALITY GUARANTEE

Goulburn Organics was established to supply fresh premium quality produce to our customers. We support Australian and local organic farmers to ensure we are able to provide the freshest best quality local produce available on the market which delivers optimum freshness, quality and flavour. What we are not able to source locally and to ensure variety in your fruit and vegetables boxes, we source produce from certified organic wholesalers. All fresh fruit and vegetables are sourced from within Australia and rarely New Zealand (for products such as blueberries and kiwi fruit). Therefore, we have no hesitation in guaranteeing the quality of all produce included in our fruit and vegetable boxes. However, due to the organic nature of our fresh produce, the external appearance of the produce may not be visually “perfect”. However, this should by no means reflect the quality of the actual fruit or vegetable in terms of freshness or flavour. We also guarantee the freshness of all other non-fruit and vegetable produce sourced from our local suppliers (for example, Taluca Park Free Range, Highlands Organics, Dandaraga Springs, Griffith Butchery, Bumnuts Australia, Branch and Burrow, Enviroganic and Windellema Organics) and that of all other products we sell to you.

We also supply fresh seafood sourced from sustainable fisheries and farms in Australia and New Zealand only. We do not supply seafood from any sources outside of Australia and New Zealand unless specifically requested by a customer as a special order. We have no hesitation in guaranteeing the quality of all fresh seafood supplied.

Please contact us immediately if one of the following scenarios occurs following the purchase of your product: 1. You are not happy with the quality or freshness of your purchase 2. The product received is not the product ordered. In the event of one of the above scenarios, we will arrange a full refund or replacement of the purchased item. Please take a photo or return in store the item that you are not happy with as soon as possible and within 48 hours of purchase.

Please note, Goulburn Organics is not responsible for any loss or damage to your product associated with inappropriate handling of your produce after pickup which may lead to tampering by pets or animals or exposure to the elements (wind, rain, heat, sun). To minimise the heat impact over the summer months, an icepack can be supplied free of charge to keep your order cool on request if you are not returning home immediately after picking up your produce but the supply of an icepack is not our guarantee that your order will stay fresh if your order is exposed to tampering by pets or animals or the elements (wind, rain, heat, sun).

OUR CANCELLATION POLICY

Your subscriptions to our products can be temporarily suspended or cancelled up to Monday noon the week of your scheduled Friday pickup/delivery day. Please send us an email to info@goulburnorganics.com.au to suspend, cancel or reactivate your subscriptions. Please note that subscription cancellations, suspensions and re-activations must be processed by noon Monday the week of your pickup/delivery day because we start to process orders with our growers and suppliers on Monday each week and payments are transferred. Therefore, you are unable to make amendments to your subscription after Monday noon the week of your scheduled pickup/delivery day. Any amendments made after noon Monday will apply to your order of the following week. If the reason for your cancellation is related to dissatisfaction with the quality of produce received (as per criteria listed above), please phone or email us directly to arrange for a full refund of the cost of your last purchased box. Alternatively, if your dissatisfaction is restricted to a specific item within your box, we will replace this item in your next box with the same produce (if available) or other produce to the same value.
